The firm's attorneys in this group are recognized for their skills and substantial history in representing individuals and companies in actions involving violations of state and federal securities laws, common law fraud, and breach of fiduciary duty claims, including class actions, shareholder derivative actions, and employment cases involving claims of wrongful termination and defamation. These cases have been litigated both in court and in arbitration under the rules and procedures of the Financial Industry Regulatory Authority (FINRA), formerly the National Association of Securities Dealers (NASD), stock exchanges and the American Arbitration Association.
Our attorneys also have extensive experience litigating disputes over the scope of arbitration clauses and arbitrator jurisdiction, as well as petitions to vacate and to confirm arbitration awards. Specifically, Alan Friedberg briefed and argued before the United States Supreme Court on behalf of the plaintiff in Howsam v. Dean Witter Reynolds, Inc., 537 U.S. 79 (2002). His success in this case confirmed that it is the arbitrator's task, not a court's, to determine certain threshold eligibility issues relating to claims under an arbitration agreement. Further, lawyers in this group have acted as arbitrators in dispute resolution proceedings under the rules of the American Arbitration Association and FINRA.
